1. Relationship and Scope

These Terms outline the rules for using HalalEats services in Australia. By placing an order or accessing the HalalEats apps or websites, you agree to these Terms.

Meshon Pty Ltd provides the technology platform and app access. Halal Pty Ltd manages delivery and marketplace services in Australia. Additional terms may apply where services are provided by affiliates.

2. HalalEats Services

HalalEats provides a digital platform that allows users to:

  • Order meals, groceries, and other goods from participating merchants
  • Request delivery services via HalalEats or third-party couriers
  • Facilitate payments for these services

HalalEats does not provide food, goods, or transportation services. These are supplied by third-party providers or affiliates.

Licence

Halal Eats grants you a limited, non-transferable licence to use its apps for personal, non-commercial use only.

Restrictions

  • Do not copy, modify, or resell the platform
  • Do not attempt to hack or reverse engineer services
  • Do not use the platform for unlawful purposes

3. Your Use

Account Setup

  • You must create an account with accurate personal details
  • Only one account per person is allowed unless approved

Eligibility

  • You must be at least 18 years old
  • Underage use is only allowed under permitted conditions

Conduct

  • Comply with all applicable laws
  • Avoid misuse or nuisance to merchants, drivers, or staff
  • Provide correct delivery details and safe access

4. Payments

Charges

  • Service Charges for delivery/platform usage
  • Third-Party Charges for goods/services

All charges include applicable taxes and are processed through the app.

Refunds

Payments are final unless required by law or HalalEats policy. Refunds may apply for failed or cancelled services not caused by you.

Cancellations

  • Orders may be cancelled within allowed time
  • Late cancellations may incur full charges
  • Courier cancellations after acceptance may incur fees

Additional Fees

You may be charged for damages or excessive cleaning beyond normal use.

5. Liability and Disclaimers

Services are provided on an "as is" basis without guarantees of uninterrupted service.

Merchants and delivery partners are responsible for their goods and services.

Consumer Rights

Nothing limits your rights under Australian Consumer Law.

Limits

  • Liability capped at AUD $1,000
  • Delivery liability limited to goods value + delivery cost
  • No liability for indirect or consequential losses

6. Dispute Resolution

Complaints are handled according to consumer law. Disputes are governed by the laws of Queensland, Australia.

7. Other Provisions

  • Privacy governed by HalalEats Privacy Policy
  • Notices sent via app, email, or post
  • App store terms may apply
  • Terms may be assigned by HalalEats
  • Invalid clauses do not affect remaining terms

8. Payment Collection, Settlement & Taxes

HalalEats collects payments on behalf of restaurants and drivers.

  • Payments are considered received at time of customer payment
  • Fees and commissions are deducted before payouts
  • HalalEats acts only as a payment collection agent

Restaurants and drivers are responsible for all applicable taxes including GST.

9. Promotional Codes

  • Must be used lawfully
  • Cannot be exchanged for cash
  • May expire or be revoked anytime

10. Complaints and Support

Support is available via the app help section for any issues related to services.
